Terms of Use
[Bocelle Clinic Online Membership Terms and Conditions]
These Terms and Conditions are intended to define the conditions, procedures, and other necessary matters related to the use of services provided by Bocelle Clinic (hereinafter referred to as the "Clinic"), in accordance with the Telecommunications Business Act and its Enforcement Decree.
Article 1 (Purpose, etc.)
- These Terms and Conditions for use of Bocelle Clinic (www.bocelle.com) (hereinafter referred to as "these Terms") aim to define the rights, obligations, and responsibilities of members and the Clinic in connection with the use of internet-related services (hereinafter referred to as "the Services") provided by the Clinic.
- Any person who wishes to become a member and completes the prescribed registration procedure set by the Clinic and clicks the "Register" button shall be deemed to have agreed to these Terms. Matters concerning the rights, obligations, and responsibilities of members and the Clinic not stipulated in these Terms shall be governed by the Telecommunications Business Act and other relevant laws and customary practices of the Republic of Korea.
Article 2 (Definition of Member)
The term "Member" refers to a person who accesses the Clinic and registers as an online member in accordance with these Terms, and who receives the Services provided by the Clinic.
Article 3 (Membership Registration)
- Any person who wishes to become a member shall apply for membership by entering member information in the registration form prescribed by the Clinic and clicking the "Register" button.
- The Clinic shall register the applicant as a member unless the applicant falls under any of the following categories:
- An applicant who has previously lost membership status pursuant to Article 6, Paragraph 3 of these Terms, except where three (3) years have passed since the loss of membership and the applicant has obtained approval from the Clinic for re-registration.
- Where false information, omissions, or errors are found in the registration details.
- Where the Clinic determines that registering the applicant as a member would cause significant technical difficulties.
- The membership agreement shall be deemed established at the time the Clinic's acceptance reaches the applicant.
- If there is any change to the information entered at the time of registration, the member shall immediately update and correct such information.
Article 4 (Provision and Modification of Services)
- The Clinic provides members with the following services:
- Clinic newsletter service
- Online consultation / reservation services
- Sections and content services exclusively for online members
- Other services provided through partnerships with affiliated companies
- The Clinic may modify the Services by notifying members of the details and effective date of such changes in accordance with Article 7, Paragraph 2.
Article 5 (Suspension of Services)
- The Clinic may temporarily suspend the provision of Services in cases such as maintenance, inspection, replacement, or malfunction of information and communication facilities, or interruption of communication. The Clinic may also completely discontinue the Services due to replacement with new services or other reasons deemed appropriate by the Clinic.
- In the event of service suspension under Paragraph 1, the Clinic shall notify members in accordance with Article 7, Paragraph 2. However, this shall not apply where prior notice is impossible due to reasons beyond the Clinic's control (such as disk failure or system shutdown without intent or negligence of the system administrator).
Article 6 (Membership Withdrawal and Loss of Membership Status)
1. Members may request withdrawal (termination of membership) at any time, and the Clinic shall promptly proceed with the membership cancellation process upon receiving such a request.
2. The Clinic may restrict, suspend, or terminate a member's membership if the member falls under any of the following circumstances:
- Providing false information at the time of registration
- Interfering with another person's use of the Clinic's site or stealing such information, thereby threatening electronic transaction order
- Engaging in acts prohibited by laws or these Terms, or acts contrary to public order and morals
- If the Clinic decides to terminate a member's membership, it shall delete the membership registration. In such cases, the Clinic shall notify the member prior to deletion and provide an opportunity to explain.
Article 7 (Notice to Members)
- When providing notice to a specific member, the Clinic may do so via the email address registered with the Clinic.
- When providing notice to an unspecified number of members, the Clinic may substitute individual notice by posting the notice on the Clinic's bulletin board for at least one (1) week.
Article 8 (Protection of Members' Personal Information)
The Clinic shall endeavor to protect members' personal information, including registration information, in accordance with applicable laws. Matters concerning the protection of personal information shall be governed by relevant laws and the Clinic's "Privacy Policy."
Article 9 (Obligations of the Clinic)
- The Clinic shall not engage in acts prohibited by laws or these Terms, or acts contrary to public order and morals, and shall strive to provide continuous and stable Services in accordance with these Terms.
- The Clinic shall establish a security system to protect members' personal information (including credit information) to ensure safe use of internet services.
- The Clinic shall not send commercial advertising emails that members do not wish to receive.
Article 10 (Obligations Regarding Member ID and Password)
- Except where the Clinic bears responsibility under relevant laws or the "Privacy Policy," responsibility for managing IDs and passwords rests with the member.
- Members shall not allow third parties to use their ID or password.
- If a member becomes aware that their ID or password has been stolen or used by a third party, the member shall immediately notify the Clinic and follow the Clinic's instructions.
Article 11 (Obligations of Members)
- Members shall not engage in any of the following acts:
- Registering false information during membership registration or modification
- Altering information posted on the Clinic
- Infringing on the personal rights or intellectual property rights of the Clinic or third parties, or interfering with business operations
- Using another member's ID
- Sending junk mail, spam mail, chain letters, pyramid scheme solicitations, or emails containing obscene or violent messages, images, or sounds, or posting information contrary to public order and morals
- Transmitting or posting information prohibited by relevant laws (such as computer programs)
- Impersonating the Clinic's staff or service administrators, or posting content or sending emails using another person's name
- Posting or transmitting materials containing software viruses or other computer codes designed to disrupt or destroy normal operation of software, hardware, or telecommunications equipment
- Stalking or harassing other members
- Collecting, storing, or disclosing other members' personal information without consent
- Engaging in profit-making activities through advertising, promotion, or spam using the Clinic's Services
- Violating these Terms or other service-related regulations set by the Clinic
- If a member engages in any act listed in Paragraph 1, the Clinic may restrict, suspend, or terminate the member's membership in accordance with Article 6, Paragraphs 2 and 3.
- Members shall be liable to compensate for any damages incurred by the Clinic or other members due to reasons attributable to the member.
Article 12 (Deletion of Public Posts)
If a member's public post falls under any of the following categories, the Clinic may delete the post without prior notice and may restrict, suspend, or terminate the member's membership:
- Content that defames or damages the reputation of other members or third parties
- Content that distributes information, text, or images contrary to public order and morals
- Content deemed related to criminal activity
- Content that infringes on copyrights or other rights of other members or third parties
- Content with a strong advertising or commercial purpose
- Content deemed to violate relevant laws
Article 13 (Ownership of Copyrights and Restrictions on Use)
- Copyrights and other intellectual property rights to works created by the Clinic belong to the Clinic.
- Members shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use information obtained through the Clinic for commercial purposes or allow third parties to use such information without prior consent from the Clinic
Article 14 (Consultation Policy)
- The content of consultations conducted through the Services may be used for the following purposes after removing personal identifying information:
- Academic activities
- Medical treatment activities
- Medical services
- Publication activities such as printed materials and CD-ROMs
- Portions of service content such as FAQs and recommended consultations
- The Clinic may refuse to provide consultation services in whole or in part in the following cases:
- Repeated consultation requests with the same content
- Use of expressions contrary to common sense or use of vulgar language
- Requests for diagnosis
- Requests regarding treatment costs, examination fees, medication prices, or medication effects
- Requests made for the purpose of obtaining information to harm others
Article 15 (Amendment of the Terms)
- The Clinic may amend these Terms within the scope that does not violate relevant laws, including the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Commerce, the Electronic Signature Act, and the Act on Promotion of Information and Communications Network Utilization.
- When amending these Terms, the Clinic shall specify the effective date and reasons for amendment and post the amended Terms on the initial screen together with the current Terms from seven (7) days prior to the effective date until the day before the effective date.
- Unless the amended Terms violate relevant laws, the amended Terms shall also apply to members who joined prior to the amendment.
- Members who object to the amended Terms may withdraw from membership in accordance with Article 6, Paragraph 1.
Article 16 (Jurisdiction)
Any lawsuit arising from disputes related to the use of Services between the Clinic and members shall be filed with the courts of the Republic of Korea having jurisdiction under the Civil Procedure Act.
Addendum
- These Terms shall take effect on June 14, 2017, and shall replace the previous Terms that were effective from June 20, 2012.
